David van Leenen – Managing Partner

David van Leenen is the managing partner at Sharek&Co. and serves as lead partner in the Real Estate and Estates service groups.

David was born in Holland, has lived and worked there, and enjoys return visits when possible. He has lived the balance of his life in the Edmonton area, and obtained his Bachelor of Arts in 1995 and his Bachelor of Laws in 1998, each from the University of Alberta.

David has been involved in the real estate industry and construction industry in one form or another for his entire adult life, and continues to enjoy all matters related to real estate and real estate developments.

David acts for condominium developers, both commercial and residential, from negotiating the initial land acquisition; assisting with mezzanine financing via private lenders and bond / mortgage unit offers; construction financing with chartered banks and other lenders; preparing purchase agreement and disclosure document packages; assisting with matters related to condominium plan registration; and dealing with all matters related to closing thousands of individual unit sales.

His work in the field of condominiums also includes acting for Boards in all matters relating to condominium life, including review of, revisions to, and enforcement of bylaws.

David also acts for single family home builders and developers, including financing for bulk lot purchases, setting up Home Owners Associations, draw / construction mortgages, preparation of the contract for sales to individual purchasers, dealing with holdback issues and closing the sale to ultimate purchasers.

David regularly acts for both buyers and sellers in multi-million dollar commercial transactions, on a wide variety of properties. As well, David acts on behalf of a Tier 1 Canadian bank for its commercial lending transactions.

David’s real estate experience also includes acting for municipalities and developers in matters related to development agreements, subdivision, land dedication issues, and reviewing and drafting agreements for registration on title.

Other aspects of David’s practice include incorporation, asset and share purchase and sale agreements, lease review, dealing with all manner of contracts in respect of the operation of a business generally, ITIN applications, and probate work.
